Florida Judge -- As Anticipated -- Rules Against Health Reform

Judge Roger Vinson today ruled that the health reform law is unconstitutional. His ruling will be appealed to the US Court of Appeals for the 11th Circuit. This is the second court to rule the law unconstitutional; the other court is in Virginia, and the US Court of Appeals for the 4th Circuit will hear that appeal in May.

Judge Vinson did not order the Obama Administration to stop implementing the law in the meantime, so all goes ahead as planned.

The judge said that the requirement that everybody purchase insurance or pay a fine/tax is unconstitutional, and since the law does not say that any one provision can be severed and the rest of the law still stand, he said the entire law is void.

Four judges now have ruled on the merits of the law, two for and two against.

I'll be reading the whole decision and will be able to give you a better idea of how this may play out after I've done so. Jennifer

  1. It matters not. Obama will ignore the decision, as he did the one on the gulf drilling ban, and full steam ahead with this and all of his agenda until he is actually stopped. He will also remain in office until he can be proven ineligible and actually be removed, highly unlikely.

  2. A birther on my blog -- how exciting! So first, have you looked at the birth certificate? Of course he's eligible. The US Supreme Court has refused to hear a challenge to his eligibility because it's such a ridiculous argument. And although you probably don't care much about reality, the JUDGE HIMSELF said he was not telling the Administration to stop implementing the law. So it's not that he's ignoring the decision -- the decision will be appealed, and ultimately the Supreme Court will rule. Until then, no court has told the government to stop implementing, so why would they? You know, I keep saying on this blog and elsewhere that I wish people would read and become informed before they take positions on issues. Jennifer
